Defects, Warranty, and Returns Policy
At Diamond Skylights, we are committed to providing high-quality products and ensuring compliance with Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (CCA).
1. Inspection and Notification
1.1. Customers must inspect goods upon delivery. Any evident defect, damage, or shortage in quantity must be reported to Diamond Skylights in writing within three (3) days of delivery.
1.2. Any other defect must be reported as soon as reasonably possible after it becomes apparent. Customers must allow Diamond Skylights to inspect the goods upon notification.
2. Consumer Guarantees
2.1. Under Australian law, including the Australian Consumer Law (ACL), certain statutory guarantees apply to goods and services provided by Diamond Skylights. These guarantees cannot be excluded.
2.2. Nothing in these terms and conditions modifies or excludes these statutory rights.
3. Warranty Limitations
3.1. Except as required by law, Diamond Skylights does not provide additional warranties beyond those expressly stated in these terms.
3.2. If the Customer is a consumer under the ACL, Diamond Skylights’s liability is limited to remedies permitted by section 64A of the ACL, such as repair, replacement, or refund.
4. Returns and Refunds
4.1. Returns will only be accepted if: the Customer has complied with the inspection and notification provisions (clause 1.1). Diamond Skylights has confirmed the goods are defective. The goods are returned in their original condition within a reasonable time.
4.2. For non-defective goods, Diamond Skylights may, at its discretion, accept returns subject to: A handling fee of up to 15% of the value of the goods. The goods being returned in as-new condition, including all packaging, brochures, and instructions.
4.3. If a refund is required but replacement is not possible, Diamond Skylights may refund the purchase price.
5. Exclusions
5.1. Diamond Skylights is not liable for defects or damage caused by: Improper maintenance or storage of goods by the customer. Use of goods for purposes other than those intended. Continued use of goods after defects become apparent. Failure to follow Diamond Skylights's instructions or guidelines. Fair wear and tear, accidents, or natural disasters.
6. Unfair Contract Terms and Compliance
6.1. In compliance with amendments to the ACL and CCA, Diamond Skylights ensures that all terms are fair, transparent, and not misleading. If a term is deemed unfair, it will not affect the enforceability of other terms.
7. Customer Rights
7.1. If required by law, Diamond Skylights will accept returns under the conditions imposed by the ACL or any other applicable legislation.
